Reporting of findings
Vantage Compliance & Mitigation (“Vantage”) shall deliver the Report to the Customer(s) according to the following schedule:
- Business Verification Report within three (3) working days after the date of purchase.
- Factory Verification Report within five (5) working days after the date of purchase.
- Other reports are delivered within ten (10) working days after the date of purchase.
Online Verification Services
Online purchase of verification reports are delivered based on information provided by the Customer. The price paid does not include follow up consultations, whether in person or via phone or email.
Payment
Payment in full is due prior to commencement of any work.
Amounts charged are in USD, unless another currency is agreed to in writing.
Cancellation
By accepting these terms, the Customer accepts this service cannot be cancelled after the order has been placed and paid for.
Information supplied
In order to adequately verify a potential supplier, the Customer must provide adequate information. In the event the supplied information is inconsistent Vantage will prioritize information provided in Chinese over information provided in English. If information supplied is inconsistent, that may be the verification result (=”Information provided is inconsistent”). Alternatively and if possible, Vantage will proceed to verify only documents provided in Chinese.
Duty of care
Vantage shall advise the customer to the best of its knowledge and experience with competence and shall perform the assigned tasks with reasonable care and skill. Vantage shall act in the best interest of the Customers at any rate.
Customer Duty of Care
It is the Customers obligation to provide any relevant information that may facilitate the accuracy of the verification. I.e. ensuring that the documents supplied are from the entity being verified. Scanned documents in Chinese will be given priority over i.e. English names.
Confidentiality
Vantage shall treat all business information as well as internal affairs of the Customer(s) strictly confidential.
Limitation of Liability
All services provided are made in good faith on the basis of information available to Vantage. Achievement of the customer’s objectives will depend among other things on the actions of the Customer as well as the Supplier being verified, over which Vantage has no control. Notwithstanding anything contained therein, neither Vantage nor its employees, officers, subcontractors or agents will, except as the law may require, be liable for any loss or other consequences arising out of the services rendered by Vantage, except where such loss or consequences are due to negligence of Vantage.
In any event, the entire and aggregate liability of Vantage for damages arising out of its non-performance or breach under this Agreement and the aggregate liability for all claims against Vantage under and in connection with the order, shall not exceed the total services fees of the order.
Use of Logo
Vantage and its affiliated companies shall be entitled to make reference to the name of the Customer(s) in its Customer(s) reference list and to the type of assignment that Vantage do for that particular Customer(s) whenever necessary. Vantage is also entitled to use the logo, mark or name of Customer(s) or any part thereof or in any form similar thereto in any literature or promotional materials or in any other promotional activity without any further written consent of the Customer(s).
Use of Information
Vantage shall be entitled to share the information of the Customer(s) obtained through the engagement with its relevant partners for the purpose of fine-tuning future service offerings.
